You believe that criminal liability would prevent doctors from prescribing unnecessary drugs to their patients. Currently, doctors can assume civil liability for the death of a patient from the victim's family for a monetary value. A civil liability is when another person sues for suffering an actual loss, such as personal injury, property damage, and/or financial loss, while a criminal liability is when a state prosecutes the defendant and they may face fines and imprisonment . Criminal liability can dissuade doctors from selling their services for profit and violating the Hippocratic Oath (where doctors swear under oath to uphold specific ethical standards). Doctors can also be convicted of a patient's fatal drug abuse through the Controlled Substances Act, as seen with Dr. Murray. The Controlled Substances Act requires that any doctor who wishes to prescribe controlled substances must register with the Drug Enforcement Association, which then must follow its specific guidelines. These guidelines state that prescriptions must be dated and include the name and address of the patient and the prescriber (Trachtman). Most violations, however, lead to the temporary suspension of all medical licenses if the doctor is convicted of murder “in the form of law”.
