This semester I worked for a law firm and saw exactly how House Bill 274 affected the law firm. I worked for a personal injury law firm called Law Office of Branch & Dhillon. I worked for Attorney Dhillon, Attorney Woron, and Attorney Barber. My go-to person, a really helpful supervisor and paralegal, was a lovely lady named Judy. Judy allowed me to explore all aspects of working at the law firm and even allowed me to have my own office, key to the firm, and my own special "lawyer" coffee carafe, everything that made me feel like I were there. The lead attorney and firm owner, Mr. Dhillon, has three offices located in Texas, Virginia and South Carolina. I have had the opportunity to collaborate and work with all of them. The main purpose of this part of the bill is to ensure that an expedited procedure is carried out and to reduce discovery for those cases that were supposed to fall within the specific range. The amount "in dispute is inclusive of any claims for damages of any kind, actual or exemplary, penalties, attorney's fees, expenses, costs, interest, or any other category of damages." In this section, we talk about how the costs of litigation that can hypothetically be awarded "shall not be greater than the total amount that the claimant recovers or would recover before adding compensation for the costs of litigation in favor of the defendant" (WebLaws ). The bill makes it more difficult to possibly inspire the need to calculate the sums of economic and non-economic damages and subtract them from liens to determine the total amount that can be awarded as charges. An example of this part of the bill would be if a "defendant made a settlement offer of $100,000 and the plaintiff rejected it, and then won the case, but only with an award of $79,000, that would mean that the plaintiff should pay the legal costs incurred by the other party, even if they amounted to more than the final award” (TexasTribune) The bill also introduced the definition of litigation costs to include costs of fair deposition Even if all this is part of the bill, there is no mention yet of what is included in a "reasonable deposition cost", which can include items such as court writer fees, expert fees, travel expenses and eyewitnesses.
