The new United States Constitution, ratified in 1789 by James Madison, created an entirely new system in America, never before attempted. The first consideration to make concerns the new institutions created by the Constitution. Prior to its adoption, America operated under the Articles of Confederation. This document gave us a set of universal values from which laws and codes emerged and were implemented. As such, it symbolizes the essence of constitutionality: that government must be limited by the rule of law. The constitution was successful in its ability to encourage the rule of wise and advanced statesmen, furthermore the creation of the three branches discouraged the negative effect of factions and prevented the government from assuming more power than it was entrusted with, furthermore he has notably refrained from using that power to curtail individual freedom. The Constitution has succeeded in its ability to encourage government by wise and advanced statesmen by allowing citizens access to apply for this position with the government. All citizens can apply for various positions after turning 25 years old. At this point most adults have experienced certain things in life that have made them wise. Furthermore, thanks to the creation of the three branches, the negative effects of factions have been discouraged. One of the many institutions that have helped deter factionalism is the legislative branch. The legislative branch is made up of two parts, the House of Representatives and the Senate. Amendments are basically things that can be added to the Constitution or change the Constitution. The men who wrote the Constitution believed that the government of the United States should remain in the future and change with the times. This allows citizens to have the opportunity to change the Constitution. However, because we have the ability to change laws with amendments, we can prevent the government from violate our rights. We did this in the past with slavery when we added the 13th, 14th, and 15th Amendments. We also have the checks and balances system. Someone will overturn the policy.
